Your terms and conditions of use

1. THE WEBSITE, VANILLA COAST LIMITED AND YOU

1.1 These terms and conditions apply to the use of www.vanillacoast.co.uk. By accessing this website and/or placing an order, you agree to be bound by these terms and conditions. Using this website indicates that you accept these terms regardless of whether or not you choose to register with us or order from us. If you do not accept these terms, do not use this website.

1.2 The www.vanillacoast.co.uk website is operated by Vanilla Coast Limited. Vanilla Coast Limited is a company registered in England and Wales, whose registered office is Hill Farm, Dalwood, Axminster, Devon, EX13 7EU, United Kingdom. Company registration number: 7131309.

1.3 References to "we", "us" and "our" shall be deemed to be references to Vanilla Coast Limited. References to "you", and "your" shall be deemed to be references to the person placing an order via this website.

2. PLACING AN ORDER

2.1 By placing an order with us you will be deemed to have read, understood and agreed to these Terms and Conditions. If you are unhappy with any aspect of these terms, then you should contact us before placing an order by email at sales@vanillacoast.co.uk or telephone us on 01404 831955.

2.2 You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgment, detailing the products you have ordered. Payment is taken immediately at the time of order.

2.3 Our acceptance of an order takes place when we despatch the order. When we despatch the order the purchase contract will be made even if your payment has been processed immediately, unless we have notified you that we do not accept your order or you have cancelled your order.

2.4 Prices and availability of goods are subject to change without notice. A delivery charge will be added to your order value where appropriate, please see the delivery section on this website.

3. YOUR RIGHT TO CANCEL

3.1 You may normally cancel your order (once accepted by us) for any reason up to the point of despatch, with the exception of products that have been made, personalised or customised specifically for you. If you do cancel the contract within this time any payments made by you will be refunded in full within 14 days for non-personalised goods. The provisions of this clause do not affect your statutory rights.

4. RETURNS POLICY

4.1 If you are not entirely satisfied with the products that you have chosen you may return them to us within 7 days of receipt. We will be more than happy to offer you an exchange or, if you wish, a refund provided that the products are returned complete, in perfect condition, unused, unwashed and with the original packaging, with the exception of products that have been made, personalised or customised specifically for you. The provisions of this clause do not affect your statutory rights.

5. MAKING RETURNS

5.1 For all returns, except where the item is faulty, you will be required to arrange and pay for the return of the products to us. If you prefer, we will arrange to collect the products from you, but the cost of this will be charged to you and may be deducted from any refund to you. We will only refund the costs of postage where the item returned is faulty.

5.2 Larger products may incur a re-stocking fee to cover the initial delivery costs, please check the product details if this is applicable.

5.3 To return any products to us, please complete the reverse side of the invoice (which comes with your order) and clearly mark whether you would like a refund or exchange. Pack the items back in the parcel, attach the invoice and send it back to:

5.4 When returning items you are recommended to obtain proof of posting. We cannot accept responsibility for parcels lost in transit.

6. PAYMENT AND TAXES

6.1 We accept online payment in a secure environment by most credit and debit cards. All transactions are shown in pounds sterling (£).

6.2 All prices quoted on this website are accurate at the time of publication and are quoted in pounds sterling (£) and where appropriate are inclusive of UK sales tax (VAT) at the current rate. If your order is being despatched to a destination outside the European Union (EU) then your sales tax will be zero. If your order is being sent to a member state of the EU then the selling price will include VAT at the current rate. Any customs or import duties levied once the package reaches your destination country will be your responsibility as we have no control over these charges and cannot predict them.

7. OUR GUARANTEE TO YOU

7.1 We endeavour to display through this website all items in our current range. We aim to hold stock of all products on this Website. However, occasionally an item will be out of stock and if this is the case this will be highlighted in your shopping basket. The stock status for your order will also be notified to you on your order confirmation.

7.2 All dates quoted for delivery are estimated delivery dates only and may be subject to change and we can accept no liability for any loss or damage (whether direct or indirect) for delivery at any time other than the estimated date for delivery. In the event that an item is temporarily out of stock or there is a delay in delivery, we will notify you of the delay and despatch it as soon as it arrives.

8. DELIVERY

8.1 UK DELIVERY

8.2 We have a standard chrage of £4.95 for UK deliveries on all orders below £100.00. Orders over £100.00 will recieve FREE DELIVERY. An additional charge will be applied for delivery to the following areas: Northern Scotland, Scottish Highlands, Offshore Islands and Northern Ireland.

8.3 Standard Items

Delivery for Standard Items will normally be between 5-7 working days.

8.4 Furniture/Bulkier Items

Delivery of bulkier items, such as furniture, will generally take between 7-14 working days. An additional charge for delivery of Furniture/Bulkier items may be applicable.

8.5 Personalised Items

Delivery of personalised items will normally take between 7-14 working days. However, if the item is urgent please contact us and we will endeavour to meet your needs.

8.6 Urgent Deliveries

We do not currently provide a next day service, however, if you require an urgent delivery please email sales@vanillacoast.co.uk or telephone 01404 831955. We will make every effort possible to meet your needs. An additional delivery charge will be applicable for urgent deliveries.

8.7 Most deliveries will require a signature, therefore please ensure that there will be someone available to sign for the parcel at the delivery address you choose. If a parcel is returned to us because the courier has been unable to obtain a signature, there may be an additional charge to have your parcel redelivered.

8.8 EURPOEAN & BFPO DELIVERY

9. CONFORMITY OF GOODS

9.1 We take every care to ensure that the description and specification of our products are correct at the time of going to press. However, specifications and descriptions of products on this website are not intended to be binding and are intended only to give a general description of the products. Furthermore, while the colour reproduction of the products is a close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used by you. Many of the products are unique, because they are handmade or hand painted by Vanilla Coast, therefore slight variances in texture, shape and colour may occur.

10. VISITOR MATERIAL AND CONDUCT

10.1 Other than personally identifiable information, which is covered under the Privacy Policy, any material you transmit or post to this Website will be considered non-confidential and non-proprietary. We will have no obligations with respect to such material. We and our nominees will be free to copy, disclose, distribute, incorporate and otherwise use such material and all data, images, sounds, text and other things embodied therein for any and all commercial and non-commercial purposes.

10.2 You are prohibited from posting or transmitting to or from this Website any material:

(a) that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience;

(b) for which you have not obtained all necessary licences and/or approvals;
